



Terms Of Service and Use Agreement
Unsolicited junk mail and commercial solicitations from people we have had no previous
communication with are strictly forbidden at any e-mail address on our servers.
By entering any of the sites on our servers or e-mailing any client thereto, you agree to be
invoiced a handling charge for each seperate occurace of $15.00 (fifteen dollars US Funds)
for processing, returning and issuing a complaint to your postmaster if your e-mail is found
to be an unsolicited junk mail message and/or commercial solicitation.
An occurance shall be deemed EACH e-mail address on our server that recieved unsolicitated
mail from you or your assigns.
You further agree not to sell or lease any e-mail address or personal information to anyone
or any firm, on penalty of legal remedies in your jurisdiction, unless we have previously
mailed you a signed and notorized document which permits you to do so. You also acknowledge
that if a complaint to your internet provider is sent, you may be liable to have your account
removed, among other remedies as allowed by law.
If you do not agree to these terms and conditions, you must leave this server immediately!.

This agreement represents the complete agreement and understanding
between InterNeTT Services Inc. of Raleigh North Carolina ,(hereinafter
refered to as InterNeTT) and the account holder. This Agreement shall
supersede any other written or oral agreement. Upon e mail or written
notification and publication, via InterNeTT Services web site
(http://internett.com/terms), InterNeTT Services may modify these terms
and conditions, amplify them, and/or modify the prices, as well as
discontinue or change the services offered 15 days after such notification.
1.0 Provision of services
1.1 InterNeTT Services will provide services on its host computing systems
to individual account holders in exchange for payment of fees and
compliance with the terms and conditions of this document and additionally
terms and conditions as stipulated on InterNeTT Services web site.
1.2 InterNeTT Services are defined as the use by the account holder of
computing, telecommunications, software, and information services
provided by InterNeTT Services . These services also include the provision
of access to computing, telecommunications, software, and information
services provided by others via the Global Internet.
1.3 InterNeTT Services will publish a notice of fee increases 30 days
before such increases take effect.
2.0 Use of Material
2.1 Public Domain materials (e.g., images, text, and programs) may be
downloaded or uploaded using InterNeTT Services web servers. Account
holders may also re-distribute materials in the public domain. The account
holder assumes all risks regarding the determination of whether the material
is in the public domain.
2.2 As provided by United States federal law and by International treaties,
copyrighted materials (e.g., Images, Text, and Programs) may not be
uploaded onto or using InterNeTT Services web servers without the express written
permission of the copyright holder AND Internett services. Copyrighted materials
may be downloaded for personal use as provided by law. Except as expressly permitted,
materials under copyright may not be distributed to others. Copyrighted material
may not be changed nor can the author attribution notices nor the copyright notices
be modified.
3.0 Use of Services
3.1 The account holder agrees to maintain a secure password to the account.
Secure passwords are those that are between 6 and 18 characters long,
contain upper and lower case letters, and numbers or other characters, and
can not be found in direct or reverse order in a dictionary, without regard to
the language of the dictionary.
3.2 The account holder agrees to use the services provided by InterNeTT
Services as permitted by applicable local, state, and federal laws. The
account holder agrees, therefore, not to use these services to conduct any
business or activity or solicit the performance of any activity that is
prohibited by law.
3.3 Use of InterNeTT Services service requires a certain level of
knowledge in the use of Internet languages, protocols, and software. This
level of knowledge varies depending on the anticipated use and desired
content of Customer's Webspace by the Customer.
The following examples are offered:
Web Publishing: requires a knowledge of HTML, properly locating
and linking documents, FTP Webspace contents, Graphics, text,
Sound, image mapping, etc. CGI-Scripting requires a knowledge of
the UNIX environment, TAR & GUNZIP commands,
The Customer agrees that he or she is a necessary knowledge to
create Customer's Webspace. Customer agrees that it is not the
responsibility of InterNeTT Services to provide this knowledge or
Customer Support outside of the defined service of InterNeTT
Services .
3.4 InterNeTT Services will exercise no control whatsoever over the
content of the information passing through the network. InterNeTT
Services makes no warranties or representations of any kind, whether
expressed or implied for the service it is providing. InterNeTT Services
also disclaims any warranty of merchant-ability or fitness for particular
purpose and will not be responsible for any damages that may be suffered
by the Customer, including loss of data resulting from delays, non-
deliveries or service interruptions by any cause or errors or omissions of the
Customer. Use of any information obtained by way of InterNeTT Services
is at the Customer's own risk, and InterNeTT Services specifically denies
any responsibility for the accuracy or quality of information obtained
through its services. Connection speed represents the speed of a connection
to and do not represent guarantees of available end to end bandwidth.
InterNeTT Services expressly limits its damages to the
Customer for any non-accessibility time or other down time to the pro-rated
monthly charge during the system unavailability. InterNeTT Services
specifically denies any responsibilities for any damages arising as a
consequence of such unavailability. In the event that this material is not
"Server-ready", InterNeTT Services may, at its option and at any time,
reject this material, including but not limited to after it has been put on
InterNeTT Services Server. InterNeTT Services agrees to notify Customer
of its refusal of the material and afford Customer the opportunity to amend
or modify the material to satisfy the needs and/or requirements of
InterNeTT Services. If the Customer fails to modify the material, as
directed by InterNeTT Services, within a reasonable period of time, which
shall be determined between the parties themselves, the Agreement shall be
deemed to be terminated.
4.0 Indemnification
4.1 The account holder acknowledges that InterNeTT Services makes an
honest effort to keep the information available on InterNeTT Services
systems accurate. However, InterNeTT Services can make no warranty of
any kind, either expressed or implied, regarding the quality, accuracy, or
validity for the data and/or information available. Use of information
obtained from or through InterNeTT Services is at the risk of the account
holder.
4.2 The account holder also acknowledges that the information available
through the interconnecting networks may not be accurate. InterNeTT
Services has no ability or authority over the material. InterNeTT Services
can make no warranty of any kind, either expressed or implied, regarding
the quality, accuracy, or validity of the data and/or information residing on
or passing through these networks. Use of information obtained from or
through InterNeTT Services is at the risk of the account holder.
4.3 The account holder agrees to indemnify and hold InterNeTT Services
harmless from any claims, including attorney's fees, resulting from the
account holder receiving InterNeTT Services which cause direct or indirect
damage to another party.
5.0 Payment of fees and penalties
5.1 The InterNeTT Services accounting cycle begins on the 1st of each
month. Charges for new accounts are prorated. Charges for terminating
accounts are not prorated.
5.2 InterNett Services will activate your account upon its order to do so.
Upon activation, the contract becomes binding for the entire term specified. If for
any reason initial or subsequent payments are not receivedat all, or are not received in
a timely fashion, the account holder agrees to pay Internett services for the entire
term of the agreement upon demand for such as allowed by law.
5.3 Payment is due upon receipt of our invoice.
5.4 Delinquent accounts are those that remain unpaid at the beginning of the
next monthly billing cycle.
5.5 Accounts that are delinquent by an accounting cycles is put on
"accounting hold" and may not be used. Accounts that are unpaid for two
accounting cycles automatically have their files archived and removed from the system.
Accounts that are unpaid for three accounting cycles have their files completely purged
from InterNeTT Services web server. InterNeTT Services accounts continue to accrue
charges while they are on hold.
5.6 There is an additional service reconnection charge equal to one half the
currently charged set-up fee to remove accounts from accounting hold status.
5.7 The account holder acknowledges responsibility for the account until
payment in full is made.
5.8 There will be a $25.00 service charge for each returned check.
6.0 Account Cancellations
6.1 Cancellation requests for InterNeTT Services accounts must be
received in writing via email, fax, or postal service at InterNeTT Services
main office. Such requests must be received by the 5 P.M. Eastern Standard
time on the 15th of the previous month in order to be processed by the
beginning of the next accounting cycle.
6.2 All InterNeTT Services accounts must be paid in full before the
transaction will be considered complete.
7.0 Abandonment of Service
7.1
Any person, persons, corporation, business or entity of any sort that
abandons a domain name and does not remove it from our server within 30 days
shall forfeit any future claim to the domain, its use and ownership. Removal from
our servers shall be defined as removing any DNS entry to our servers from internic.
In addition, If any future claim to the domain is made, the claimant agrees to pay
in full for the term from cancellation to the date of release, and any past monies
that may be owed for prior services rendered.
8.0 Abuse of Services
8.1 Any use of InterNeTT Services system resources that disrupts the
normal use of the system for other InterNeTT Services customers is
considered to be abuse of system resources and is grounds for
administrative intervention. Some examples of system abuse include
spawning dozens of processes, consuming excessive amounts of memory or
CPU for long periods of time.
8.2 Depending on the nature and the severity of the abuse, the user may
receive an E-mail warning or have their account suspended by InterNeTT
Services. If the misuse is unintentional, the suspension may be rescinded
following discussion with InterNeTT Services. If the misuse is intentional,
the suspension may be rescinded at the discretion of InterNeTT Services,
and may require the payment of a service reconnection charge.
Occasionally, unintentional misuse is classified as intentional misuse.
Customers who believe their activity has been classified in error may appeal
to InterNeTT Services.
8.3 Violations of any of the InterNeTT Services conditions of use are
unethical and may be criminal offenses. You are expected to report to
InterNeTT Services any information you may have concerning instances in
which the conditions of use have been or are being violated. When
InterNeTT Services becomes aware of possible violations, we will initiate
an investigation. At the same time, in order to prevent further possible
unauthorized activity, InterNeTT Services may suspend access to services
to the individual account in question.
Confirmation of violations may result in cancellation of the individual
account and/or criminal prosecution. The account suspension may be
rescinded at the discretion of the Operations Manager, following payment
of a reconnection charge.
